General Terms and Conditions (GTC)

  1. General

1.1 These Terms and Conditions apply to all contracts for the sale of digital products (e.g. license keys, activation codes and download links) concluded between Lizenzmarkt.ch and its customers.

1.2 Any deviating or supplementary terms and conditions of the customer shall not become part of the contract unless Lizenzmarkt.ch expressly agrees to their validity in writing.

1.3 By completing a purchase, the customer agrees to these terms and conditions.

  1. Conclusion of contract

2.1 A contract is concluded as soon as the order has been confirmed by Lizenzmarkt.ch by email or other electronic means.

2.2 Since digital products are personalized or immediately available content, the right of withdrawal does not apply after delivery of the code/link (Art. 40c OR and Art. 16 lit. m VRRL).

2.3 The customer is obliged to ensure that the email address provided is correct and that the digital products can be received.

  1. Prices and payment

3.1 All prices are in Swiss francs (CHF) or euros (EUR), unless otherwise stated, and include VAT.

3.2 Payment shall be made in advance, by credit card, PayPal or other specified payment methods.

3.3 Lizenzmarkt.ch reserves the right to process orders only after successful payment.

  1. Delivery of digital products

4.1 Delivery shall be made exclusively electronically by providing an activation code and/or a download link.

4.2 The code and/or download link will generally be sent via email within 24 hours of receipt of payment. Delays due to technical issues remain reserved.

4.3 After the code has been transmitted, delivery is deemed to have taken place.

  1. License and rights

5.1 By purchasing a license code, the customer acquires a right of use in accordance with the license terms of the respective manufacturer (e.g. Microsoft, Adobe).

5.2 The customer is obligated to comply with the manufacturer's license terms. Lizenzmarkt.ch is not liable for any violations of these terms by the customer.

5.3 Resale or reproduction of the license codes is prohibited unless expressly permitted by the manufacturer.

  1. Warranty and liability

6.1 For digital products, the statutory guarantee under Swiss law (Art. 197 et seq. OR) or the manufacturer’s specifications applies.

6.2 Lizenzmarkt.ch guarantees that the codes delivered are valid at the time of transmission and enable the customer to use the codes as agreed.

6.3 Lizenzmarkt.ch is not liable for damages resulting from improper use, technical incompatibility or violations of license terms.

6.4 In case of problems with a code, Lizenzmarkt.ch will attempt to remedy the situation or provide a replacement code within 10 working days.

  1. Disclaimer

7.1 Lizenzmarkt.ch is not liable for technical disruptions (e.g. server failures) that affect the provision of download links.

7.2 Liability for slight negligence is excluded to the extent permitted by law.

  1. Return and cancellation

8.1 Digital products (codes and download links) are excluded from return, as they cannot be returned after transmission (Art. 40c OR, Art. 16 lit. m VRRL).

8.2 The customer expressly agrees that the right of withdrawal expires upon provision of the digital product.

  1. Data protection

9.1 Lizenzmarkt.ch processes customer data in accordance with the applicable data protection regulations (GDPR and Swiss DSG).

9.2 Only data necessary for contract processing will be stored. Data will only be shared with third parties within the framework of legal regulations.

  1. Place of jurisdiction and applicable law

10.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

10.2 The place of jurisdiction is St. Gallen, Switzerland. For consumers residing in the EU, the mandatory consumer protection regulations of the respective country also apply.
